WHAT THE POLICIES SAY

BetterHelp is an online therapy/counseling service and one of two reportable segments (alongside Integrated Care) of Teladoc Health, Inc., a publicly traded (NYSE: TDOC) company that discloses BetterHelp by name in its SEC 10-K filings. Its privacy policy (last updated and effective March 17, 2026) collects identifiers, contact info, and CCPA-defined categories including Biometric Information and Sensitive Personal Information tied to identity, and self-declares that opting in to Advertising cookies and web beacons "may be considered a 'sale' of personal information" under California law. In March/July 2023 the FTC brought and finalized an enforcement action finding BetterHelp had disclosed consumers' email addresses, IP addresses, and health-questionnaire information to Facebook, Snapchat, Criteo, and Pinterest for advertising despite promising to keep such data private; the final order banned health-data sharing for advertising and re-targeting and required BetterHelp to pay $7.8 million, the largest FTC settlement of its kind to that point. Its Apple App Store privacy label discloses Location and Usage Data used to track users across other companies' apps and websites, and Health & Fitness and Sensitive Info data linked to identity for third-party advertising. The FTC has since carried out that penalty: the refund administrator disbursed nearly $5.2 million to affected customers in June 2024 and a further $2.6 million to more than 534,000 people in 2025, covering every BetterHelp-family brand including MyTherapist, Teen Counseling, Pride Counseling, and Regain. A March 2023 legal analysis of the FTC's complaint detailed how BetterHelp uploaded clients' hashed email addresses to Facebook knowing Facebook could reverse the hashing to identify individuals for ad targeting.

The FTC's BetterHelp Refunds page (updated April 8, 2025) confirms the agency executed the $7.8 million settlement in practice: the refund administrator sent a first round of payments in June 2024 totaling nearly $5.2 million, and a second round in 2025 of over $2.6 million to more than 534,000 people who had accepted their first payment. The page restates the FTC's finding that BetterHelp promised to keep user information private but revealed email addresses, IP addresses, and personal answers to health questions to Facebook, Snapchat, Pinterest, and Criteo for advertising, and lists all affected BetterHelp-family brands (BetterHelp, MyTherapist, Teen Counseling, Faithful Counseling, Pride Counseling, iCounseling, Regain, and Terappeuta) as included in the refund program for anyone who paid for services between August 1, 2017 and December 31, 2020.

Arnold & Porter's Enforcement Edge blog reported on March 15, 2023, analyzing the FTC's newly proposed $7.8 million consent order, that the FTC alleged BetterHelp uploaded the email addresses of all of its current and former clients to Facebook so Facebook could identify similar consumers and target them with BetterHelp advertising, allegedly bringing in tens of thousands of new customers. The analysis notes the emails were hashed but that the FTC said BetterHelp knew Facebook could un-hash them, and that the FTC's press release stated hashing does not protect privacy if a third party can reverse it. Under the proposed order, BetterHelp had to pay $7.8 million toward partial refunds (the first FTC action returning funds to consumers over allegedly compromised health data), stop sharing identifiable mental-health information or personal information for ad targeting, and obtain affirmative consent before sharing data going forward.

BetterHelp's current Privacy Policy still self-declares that its advertising practices may constitute a data "sale": 'If you opt in to our use of Advertising cookies and web beacons, this use may be considered a "sale" of personal information under that specific California law,' offset only by a do-not-sell opt-out.
